Terms of Service — Brandy and Co Media Social App
These Terms of Service apply to the use of the Brandy and Co Media Social App, including any related website, dashboard, integration, workflow, reporting or social media management features provided by Brandy and Co Media.
By accessing or using the Brandy and Co Media Social App, you agree to these Terms. If you use the app on behalf of a company, client, agency, Facebook Page, Instagram account or other organisation, you confirm that you are authorised to accept these Terms on their behalf.
1. About the service
The Brandy and Co Media Social App is a business social media workflow app used to support content planning, publishing, scheduling, analytics, campaign reporting and operational marketing support.
The app may connect to third-party platforms, including Meta platforms such as Facebook, Instagram and Meta Business tools, where authorised by the relevant account owner, page administrator or business representative.
2. Eligibility and authorised use
The app is intended for business and professional use. You may only use the app if:
- you are legally able to enter into these Terms;
- you are authorised to manage or access the relevant business, Facebook Page, Instagram account, Meta Business account or client workspace;
- the information you provide is accurate and not misleading; and
- your use of the app complies with applicable laws, platform rules and these Terms.
You may not use the app to access, manage or publish content for any account, page, profile or business asset unless you have proper authority to do so.
3. Account access and security
You are responsible for maintaining the confidentiality and security of your login details, connected accounts and platform permissions. You must notify Brandy and Co Media if you become aware of unauthorised access, misuse or a compromised account.
4. Meta, Facebook and Instagram integrations
Where the app connects to Meta platforms, including Facebook and Instagram:
- you must comply with Meta's applicable terms, policies and platform rules;
- you must only grant permissions that you are authorised to grant;
- you remain responsible for content submitted, scheduled or published through your connected accounts;
- you may disconnect the app through Meta, Facebook, Instagram, Meta Business tools or the app where available; and
- Brandy and Co Media is not responsible for changes, outages, restrictions, API limits, policy changes or account actions imposed by Meta or any other third-party platform.
5. User content and client materials
You retain ownership of content, materials, brand assets, campaign information, instructions and other materials that you submit to the app or authorise us to process.
You grant Brandy and Co Media the rights necessary to process, store, display, modify, schedule, publish, analyse or otherwise use that content solely for the purpose of providing the app and related services.
You confirm that you have the necessary rights, licences and permissions for all content you submit or authorise, including text, images, videos, logos, trademarks, links and third-party materials.
6. Acceptable use
You may not use the app to:
- violate any law, regulation, court order or platform policy;
- infringe intellectual property, privacy, publicity or other rights;
- publish unlawful, misleading, defamatory, harmful, discriminatory, abusive or deceptive content;
- impersonate another person, business or organisation;
- access accounts, pages, profiles, systems or data without authorisation;
- upload malware, harmful code or disruptive material;
- interfere with the security, availability or integrity of the app;
- reverse engineer, scrape, overload or misuse the app or its APIs; or
- use the app for spam, fraudulent activity or unauthorised direct marketing.
7. Review, approval and publishing responsibility
Where the app supports content creation, scheduling, approval or publishing, you remain responsible for reviewing and approving content before publication unless a separate written agreement states otherwise. Brandy and Co Media may assist with strategy, content preparation, scheduling, reporting or workflow execution, but final responsibility for published content, account permissions and business decisions remains with the authorised user, client or account owner.
8. Third-party services
The app may rely on third-party services, including hosting providers, analytics tools, email providers, Meta platforms, Facebook, Instagram and other integrated services. Brandy and Co Media is not responsible for third-party services that it does not control.
9. Fees and commercial terms
Fees, payment terms, service packages, retainers or project-specific arrangements may be set out in a separate proposal, quotation, statement of work, invoice or client agreement. Where a signed client agreement conflicts with these Terms, the signed client agreement applies to the extent of that conflict.
10. Privacy and data protection

11. Data deletion and disconnection
Users may disconnect Meta integrations through Facebook, Instagram, Meta Business settings or the app where available. Users may request deletion of personal information associated with the app using the process described at: https://brandyandcomedia.co.za/privacy/social-app-data-deletion/
12. Intellectual property
Brandy and Co Media owns or licenses the app, platform structure, workflows, software, documentation, designs, branding, templates and other materials that are not user content or client materials. You may not copy, reproduce, modify, distribute, sell, licence or exploit the app or any Brandy and Co Media materials except as expressly permitted.
13. Availability and changes
We aim to keep the app available and functional, but we do not guarantee uninterrupted or error-free access. The app may be updated, changed, suspended or discontinued from time to time.
14. Warranties and disclaimers
The app is provided on an "as is" and "as available" basis. Brandy and Co Media does not guarantee that the app will always be available, secure or error-free, or that use of the app will produce any specific marketing, sales, traffic, ranking, engagement or business outcome. Nothing in these Terms excludes any rights or remedies that cannot be excluded under applicable law.
15. Limitation of liability
To the extent permitted by South African law, Brandy and Co Media will not be liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, goodwill, data, business opportunities or anticipated savings arising from use of the app. Where liability cannot be excluded, it will be limited to the maximum extent permitted by law.
16. Suspension and termination
We may suspend or terminate access to the app if you breach these Terms, misuse the app or connected platforms, required permissions are withdrawn, continued access creates security or legal risk, or commercial arrangements are not maintained. You may stop using the app or disconnect integrations at any time.
17. Governing law
These Terms are governed by the laws of the Republic of South Africa. Any dispute arising from these Terms or use of the app will be handled in accordance with South African law, subject to any dispute resolution process agreed separately in writing.
18. Changes to these Terms
We may update these Terms from time to time. The updated version will be published on our website with a revised effective date. Continued use of the app after updated Terms are published means you accept the updated Terms.
